SJSU cannot consult over layoffs

Why faculty were not consulted

Only allowed exception is the Academic Senate
Not only is it unlikely the university would consult with anybody else (with the exception of the academic senate) but the staff union on layoffs, it is also illegal. I am referencing the Higher Education Employee-Employer Relations Act (HEERA) which says:

It shall be unlawful for the higher education employer to… Consult with any academic, professional, or staff advisory group on any matter within the scope of representation for employees who are represented by an exclusive representative… For the purposes of this subdivision, the term “academic” shall not be deemed to include the academic senates.
